Terms and Conditions of Sale

Welcome to Best Line Supply's Online Sales Terms and Conditions. These Terms and Conditions govern sales made on the Best Line Supply ("Seller") online sales webpage. Buyer agrees to be bound by these Terms and Conditions by clicking on the "I Agree" button on the checkout page. We reserve the right to amend these Terms and Conditions at any time by posting amended terms and conditions on our website with a revised effective date.

Terms or conditions contained in any order form or other document submitted by Buyer which are inconsistent with, or in addition to, these Terms and Conditions are rejected, objected to and shall be deemed void and of no force or effect.

THIS IS A LEGAL AGREEMENT. BY PLACING AN ORDER FOR PRODUCTS, YOU ARE ACCEPTING AND AGREEING TO THESE TERMS AND CONDITIONS OF SALE ON BEHALF OF YOURSELF OR THE ENTITY YOU REPRESENT IN CONNECTION WITH THE PREORDER OR PURCHASE. YOU REPRESENT AND WARRANT THAT YOU HAVE THE RIGHT, AUTHORITY, AND CAPACITY TO ACCEPT AND AGREE TO THESE TERMS & CONDITIONS OF SALE ON BEHALF OF YOURSELF OR THE ENTITY YOU REPRESENT. YOU REPRESENT THAT YOU ARE OF SUFFICIENT LEGAL AGE IN YOUR JURISDICTION OR RESIDENCE TO PURCHASE AND USE PRODUCTS AND TO ENTER INTO THIS AGREEMENT. IF YOU DO NOT AGREE WITH ANY OF THE PROVISIONS OF THESE TERMS & CONDITIONS, YOU SHOULD NOT PURCHASE THE PRODUCTS.

Price: Prices listed are for immediate ordering only and are subject to change. Changes in the quantity, payment terms, shipping destination or special handling that differs from quote may result in price adjustments. All items quoted as stock are subject to prior sales without notice. Minimum order quantities may be required and will be noted on quotations.

Order: All orders placed by Buyer are subject to acceptance by Seller. Orders may not be cancelled or rescheduled without Seller’s written consent. Seller may designate certain Products and Services as "Non-Cancelable, Non-Returnable ("NCNR") and the sale of such Products shall be subject to the special terms and conditions contained in Seller’s Customer Acknowledgement, which shall prevail and supersede any inconsistent terms and conditions contained herein or elsewhere.

Order Processing Time: All orders will take some time to process prior to shipping out. This time allows us to receive the order, review and confirm your order, process the payment, send instructions to our warehouse, pick and pack the order, handle any documentation and prepare the shipment for pick up by the courier/shipping company. All in-stock orders ship within 1- 3 business days, Monday to Friday. Items that are not-in-stock will take additional lead time prior to shipping. If you would like detailed turn around or lead times, please contact us.

Payment: All credit card payments shall be deemed authorized by Buyer and Buyer agrees not to dispute or "charge back" any such credit card payments. Payment may be made as specified on the Best Line Supply’s Quote: by check, money order, credit card, PayPal or wire transfer (all fees are borne by the Buyer). Where Seller has extended credit to Buyer, terms of payment shall be Net 30 days from date of invoice, without offset or deduction. On any past due invoice, Seller may impose interest at the rate of 1.5% per month. If Buyer fails to make each payment when it is due, Seller reserves the right to change or withdraw credit and thereby suspend or cancel performance under any or all purchase orders or agreements in which Seller has extended credit to Buyer. In the event of default by Buyer, Seller shall be entitled to costs, fees, and expenses, including but not limited to recovery of attorney fees, court costs and fees, and collections costs.

Shipping: We can ship products anywhere in the United States or Canada using the shipping method of your choice. Best Line Supply's default shipping carrier is UPS. We can ship APO for US military customers. Shipping charges vary per item and will be calculated for you automatically online. When you place an order we will estimate delivery dates based upon the availability of your item(s), shipping method selected and your shipment’s destination. 

Expedited Shipping: Please contact us to confirm if Best Line Supply can accommodate expedited shipping for rush orders.

Tracking Numbers: You will receive an email the day your order ships with the tracking number for your shipment.

Shipping Address: Best Line Supply will only accept shipments to a valid street address. Best Line Supply does not deliver to P.O. Boxes. Please confirm the address you provided for shipment is correct. We will not accept any liability or responsibility for a shipping address that was entered incorrectly including, but not limited to, shipments delivered to an incorrect address, package delay, or costs associated with resending the item to the correct address.

Acceptance: Shipments are deemed to have been accepted by Buyer upon delivery of the said shipments to Buyer, unless rejected upon receipt. Please inspect all items upon arrival and notify us of any shortages. Buyer shall perform all inspections and tests Buyer deems necessary as promptly as possible but in no event later than 5 business days after delivery of product, at which time Buyer will be deemed to have irrevocably accepted the Products. Any discrepancy in shipment quantity must be reported within 5 business days after delivery.

Claims: If Best Line Supply is not contacted within timeframe specified below from delivery date, you might not be eligible for any refund.

Order Cancelation: Once the Seller accepts an order, there is no guarantee the order may be cancelled. Any order that is not able to be cancelled must be accepted upon delivery and you must request a Return Materials Authorization (RMA) for a refund.

Taxes: Best Line Supply shall not be responsible for the payment of any use tax, sales tax, excise tax, duty, custom, inspection or testing fee, or any other tax, fee or charge of any nature whatsoever imposed by any governmental authority, on or measured by the transaction between, with the sole exception of any sales taxes invoiced and collected from you by Best Line Supply.  All other charges (if any) must be paid by Buyer separately and in addition to the prices quoted or invoiced.  In the event Best Line Supply is required to pay any such tax, fee or charge, you shall reimburse Best Line Supply therefore; or, in lieu of such payment, you shall provide Best Line Supply at the time the order is submitted an exemption certificate or other document acceptable to the authority imposing the tax, fee or charge.

Delivery: All deliveries are made "F.O.B." place of shipment. Title and risk of loss pass to the Buyer upon delivery of the Product to the carrier. Seller's delivery dates are estimates only and Seller is not liable for delays in delivery or for failure to perform due to causes beyond the reasonable control of the Seller, nor shall the carrier be deemed an agent of the Seller. A delayed delivery of any part of an Order does not entitle Buyer to cancel other deliveries.

Transit Time: Transit times stated are the typical time taken from pick-up to drop-off. It does not include any lead-time for not-in-stock or special order items.

Stock: If your product is not in stock, we will let you know. If only a portion of your order is in stock, you may decide whether you want to split-ship or ship complete. Additional shipping charges may apply for split-shipments.

Returns: A Return Material Authorization (RMA) is required for all returns.

A Return Material Authorization (RMA) is an identifying number that allows us to track your return. A Return Authorization ensures you are properly credited for your return.  All returns must have a Return Authorization.

Please complete the online RMA Form, a representative will review the request and will provide further instructions on how to proceed. Please allow 48 - 72 business hours to review and investigate the RMA request.

Returns made without prior authorization will be denied.

Non-Cancelable / Non-Returnable Products: All products which are "built to order" or "made to order", or any item that requires HAZMAT shipping are non-refundable and non-returnable as specified by the manufacturers’ policies. This is non-negotiable.

Return Condition: Items must be returned in the original packaging and in the same condition as sold, and must include all product literature / instructions and blank warranty cards. Please do not write or place any stickers or labels on the original manufacturer’s packaging. If you return an item that has been opened or shows signs of wear or damage, we will issue a partial refund minus a restocking fee, both original shipping charge and return shipping fees.

Return Address: It is important that an RMA # is marked on the box and that the return package is shipped to the exact address provided in the Return Instructions. Use a shipping method that provides package tracking. Clearly mark your package with your RMA number.

Return Time Frame: You may return or exchange an item, with an approved RMA, within 5 days of receipt. Once a RMA is issued, you have 5 days to initiate the shipment of returning the item. If the item is not returned within that time period, a new RMA number must be requested and re-approved.

Return Shipping Charges: Unless you are returning a defective item, you will be responsible for all return shipping fees. The original shipping charge is not refundable. The customer is responsible for any and all shipping charges to return the product. We refund the full cost of the merchandise and all original shipping charges if your return is a result of our error.

Pre-paid Shipping Label: If you are offered a pre-paid return label, please be aware that each of these labels is assigned to a specific return. To make sure that you receive the correct refund, please do not include parts from multiple orders or shipments in same box.

Shipping Method: The item must be shipped by a traceable shipping method and the tracking information must be provided to Best Line Supply for record purposes.

Insurance of Return: The customer is responsible for insuring for the return shipment. The recommended insurance is the original product invoice value. Best Line Supply will not be responsible for lost or damaged merchandise.

Damaged/Lost Returns: If we receive the product damaged or it is lost in transit, you are responsible for filing any claims directly with your shipping company. Please allow at least 48-72 business hours from receipt for a reply as to how we will proceed.

Returns Inspection: Items returned will be inspected for damage or misuse at which time they may be subject to restocking fees, other fees or refused, prior to the issuance of any credit.

Restocking Fee: Any product returned by Buyer due to Buyer’s error may be subject to a restocking charge up to 50% of the value of Product as specified in Seller’s invoice to Buyer.

Credit for Returns: Credit for refunds will be processed toward the same credit card used for payment of the original purchase. Credit will be processed within ten (10) business days after receipt of the product(s), allowing time for the receiving and evaluation process.  We are not responsible for the time or any delay it may take for the posting of the credit on your credit card statement.

Returning Products that Received Our Free Shipping Deal: If your purchase was eligible for our Free Shipping Deal and you request a credit or refund for your return, we will credit or refund you minus the original cost to ship the item. If you exchange an item that was part of our Free Shipping Deal for a different item, you will be charged for shipping on your replacement item.

Returns of Non-Defective Products for Refund: Non-Defective products will be authorized for return within 5 days of the shipment receipt date if the equipment is still in new, re-sellable condition with the original manual(s), accessories, packing material and carton. Restocking fees will apply. We reserve the right to reject returns in which there is no original packaging, missing accessories, damage or visible signs of usage of the item.

Defective Product: Defective products may be returned for warranty repair/exchange within 5 days of the shipment receipt date.  After 5 days, returns will be handled by direct contact and in accordance with the warranty terms of the item's manufacturer.  Items that have malfunctioned due to mishandling, electrical overload, etc., will be subject to a repair charge by Product manufacturer. 

Damaged Product: If the package you receive is obviously damaged - make sure not to refuse it. First, check if the purchased product was damaged. In most cases the damage is on the outer box only and does not affect the product. If the product is found to be damaged, please Contact Us to request an RMA number as described above. Returns made without prior authorization will be denied.

Product Warranty: All items ship with the Manufacturer's standard warranty and are subject to the Manufacturer's terms & conditions.

Limitation of Liabilities: Buyer shall not be entitled to, and Seller shall not be liable for, loss of profits or revenue, promotional or manufacturing expenses, overheads, business interruption cost, loss of data, removal or reinstallation costs, injury to reputation or loss of buyers, punitive damages, loss of contracts or orders or any indirect, special, incidental or consequential damages of any nature. Buyer’s recovery from Seller for any claim shall not exceed the purchase price paid for the affected products, irrespective of the nature of the claim whether in contract, tort, warranty, or otherwise. Buyer will indemnify, defend and hold Seller harmless from any claims based on Seller’s compliance with Buyer’s designs, specifications, or instructions; modification of any products by anyone other than Seller, or use in combination with other products.

International Orders: Please submit a message to us from the Contact Us page if you would like to discuss international ordering options. International shipments take longer to prepare due to the additional paperwork required. Delivery times are estimates only and are not guaranteed for any international shipments. Customers will be contacted with shipping costs and transit time. International customers may opt to send their shipments to a US address (like a freight forwarder) using US shipping rates and transit times. We do not cover any import, duties or taxes that may be levied on international shipments.

Export Control: Buyer certifies that it will be the recipient of the Products to be delivered by Seller. Buyer understands that the associated hardware, software, and/or technical data ("products") listed on the Order includes items that are governed by the U.S. Export Administration Regulations ("EAR"), by the U.S. Foreign Assets Control Regulations ("OFAC") and the International Traffic in Arms Regulations ("ITAR"). The Buyer understands that its sale or distribution of said products may constitute exports or re-exports, and as such, must be in accordance with the requirements administered by Bureau of Industry and Security, Department of Treasury, and Department of State. It is understood that the country of ultimate destination, commodity classification, end-user, or end-use for any said products, could affect the applicable license requirements and exportability. The Buyer agrees to consult various resources, such as the EAR, ITAR, and OFAC, by the U.S. Department of Commerce’s Bureau of Industry and Security’s ("BIS") Export Counseling Division, and other appropriate Government Sources to ensure that the sales and distribution of said products, is processed in accordance with all applicable laws. The Seller will not transfer any export-controlled products to a non- "U.S. Person" without the proper authority of the United States Government, and the buyers written approval.

Prohibited Countries: Best Line Supply complies with US export regulations that prohibit trade with the following countries: Cuba, Iran, North Korea, Sudan, Syria. More information can be found here.

Use of Products: Products sold by Seller are not designed, intended or authorized for use in life support, life sustaining, nuclear, or other applications in which the failure of such Products could reasonably be expected to result in personal injury, loss of life or catastrophic property damage. If Buyer uses or sells the Products for use in any such applications: Buyer acknowledges that such use or sale is at Buyer’s sole risk; Buyer agrees that Seller and the manufacturer of the Products are not liable, in whole or in part, for any claim or damage arising from such use; and Buyer agrees to indemnify, defend and hold Seller and the manufacturer of the Products harmless from and against any and all claims, damages, losses, costs, expenses and liabilities arising out of or in connection with such use or sale.

Force Majeure: Nonperformance of either party shall be excused to the extent that performance is rendered impossible by strike, fire, flood, governmental acts or orders or restrictions, failure of suppliers, or any other reason where failure to perform is beyond the reasonable control of and is not caused by the negligence of the nonperforming party.

Typographical Errors: In the event a product is listed at an incorrect price due to typographical error or error in pricing information received from our suppliers, Best Line Supply shall have the right to refuse or cancel any orders placed for product listed.

General: The laws of the State of South Dakota will exclusively govern any dispute between Seller and Buyer; Buyer may not assign this Agreement without the prior written consent of Seller. Seller or its affiliates may perform the obligations under this Agreement. This Agreement is binding on successor and assigns; Products, including software or other intellectual property, are subject to any applicable rights of third parties, such as patents, copyrights and/or user licenses.
